The Accra High Court has cleared Tobinco Pharmaceuticals Limited (TPL) and its Group Chairman, Elder Dr Samuel Amo Tobbin over allegations of importing fake drugs into Ghana.

This ruling was delivered by Her Ladyship Audrey Kocuvie-Tay on July 29, 2024, contrary to claims made by Dr. Stephen Kwabena Opuni, the former Chief Executive Officer of the Food and Drugs Authority (FDA).

The ruling comes after five years of legal battle which commenced on July 19, 2019.

In a press release, Tobinco Pharmaceuticals said the court found that the accusations were baseless and that the Dr. Opuni-led FDA constituted an abuse of power.

“The court found evidence of coercion in obtaining confession statements from Elder Dr. Tobbin and Mr. Kamath, using documents prepared by the BNI with letterheads taken from Tobinco’s offices.

“The FDA’s prohibition of Tobinco’s products and the ban on Bliss GVS Pharma Limited’s exports to Ghana were ruled unlawful as they lacked proper authorization from the Minister of Health,” portions of the release read.

The release added that, the company and its CEO, it is a positive feeling and they welcome the court’s ruling.
